Purpose
The purpose of this policy is to establish the conditions under which a certification issued by Server Certify for responsible alcohol service training may be invalidated or revoked. This policy ensures compliance with Iowa’s regulations for responsible server training providers and maintains the integrity of our certification program.
Grounds for Certificate Invalidation
A certificate issued by Server Certify may be invalidated or revoked under the following circumstances:
- Fraud or Misrepresentation: If the certification was obtained through fraudulent means, misrepresentation of identity, or submission of false information.
- Violation of State Alcohol Laws: If the certificate holder is found to have violated state or local alcohol service laws, resulting in disciplinary action from the Iowa Alcoholic Beverages Division (ABD) or other regulatory authorities.
- Failure to Complete Training Requirements: If an individual was mistakenly certified without successfully completing all required coursework and assessments.
- Tampering or Alteration: If the certificate has been altered, forged, or misrepresented in any way.
- Regulatory Non-Compliance: If Server Certify is directed by the Iowa ABD or another regulatory body to revoke a certificate due to changes in compliance requirements.
- Expiration of Certification: If the certification has exceeded the validity period as defined by Iowa state regulations and has not been renewed.
Process for Certificate Invalidation
- Investigation: Server Certify will conduct an internal review upon receiving a report of potential grounds for certificate invalidation.
- Notification: The certificate holder will be notified in writing of the pending invalidation and given an opportunity to respond within 10 business days.
- Determination: A final decision will be made by Server Certify based on the available evidence and any response from the certificate holder.
- Revocation and Record Update: If the certificate is invalidated, it will be marked as revoked in our records, and relevant regulatory agencies and employers may be notified as required.
- Appeal Process: A certificate holder may submit an appeal within 15 days of notification to request a review of the decision.
Reissuance of Certificates
- If a certificate was invalidated due to clerical error or incorrect processing, Server Certify may issue a corrected certificate.
- Individuals whose certificates were revoked due to misconduct or violations must re-enroll and complete the training program to regain certification eligibility.
